  • 1. Description of Services. The parties agree that F5 Photography & its team shall be the exclusive Photographers retained by the Client for the purpose of photographing the wedding. Family and friends of the Client shall be permitted to photograph the wedding as long as they shall not interfere with the Photographer’s duties. Photographic coverage shall include the services of the Photographer and an assistant (optional), to begin at an agreed upon time prior to the start of the wedding. The images shall be colour and black & white and editing shall be limited to cropping/resizing, colour correction and white balance. Artwork, airbrushing and photo enhancements are included within limitations, but if client shall request unreasonable editing then client is responsible and understand that they will incur an additional post-processing charge. F5 Photography shall provide to the Client an online web gallery of all photographs in high resolution JPEG format via online download or USB. Additional items shall be included based on the Wedding Package chosen.

    2. Product Delivery. Within twelve weeks following the event F5 Photography will provide the finished JPEG’s to the Client via a private online gallery. The online proofing gallery shall be available for viewing for six months from the date of the event. All items purchased shall be delivered to the client at a mutually agreeable date, time, location or shipping method. If an album has been purchased as part of the package, the clients must select images for the album within 3 months of receiving the online gallery link. If album selections are not made within this time, the album is forfeit and no refunds shall be made by F5 Photography Ltd. Finished albums take approximately twelve weeks for production from the point the client has approved the final album design. Any changes to the album design are made within 4 weeks of receiving the online gallery photos and album proof. If this deadline is not met, additional surcharges may be applicable. Additional album changes over the allocated amount given made prior to final approval are available for £25 per Client-requested change. If the client, does not select images for their album, within two weeks of receiving their full wedding gallery, an additional charge of £250.00 will be applicable. The client understands and is in agreement that it is their responsibility to approve the final album proof before the album is submitted for production. Should there be any changes after the albums are delivered to the client then the Client understands they will be responsible for the reproduction costs and shipping costs of the album, at which time price is based off individual pricing.

    3. Retainer and Payment. The Client understands that they will provide a 25% non-refundable deposit to F5 Photography for the total amount payable as stated above to retain the Photographer to perform the services specified herein upon signature of this contract. At such time as this order is completed, the retainer shall be applied to reduce the total cost, a further 50% must be paid before 8 weeks before the date of the wedding and thereafter the Client shall pay the remaining balance due just before they receive high resolution images or just before sending the wedding album to print. No part of any order shall be released until payment is received in full. Pricing is defined by the Photographer's price list in effect at the date of this agreement. Prices quoted for professional services, photographs and albums are guaranteed for a period of six months following the date of the wedding. Orders placed after six months following the date of the wedding are billed at the rates in effect on the most recently published price lists. Acceptable forms of payment include cash, personal cheques and bank transfers. A £25.00 fee with be charged for any returned bank cheques.

    4. Cancellation. If the Client shall cancel within sixty (60) days of the wedding date and payment has been made beyond the non-refundable retainer, a refund of any payment minus the retainer and 25% of the value of the contract will be made to the Client. If Client shall cancel within thirty (30) days of the wedding date and payment has been made beyond the nonrefundable retainer, a refund of any payment minus the retainer and 50% of the value of the contract will be made to the Client. Any requests for refund must be in writing and e-mailed to the Photographer within the cancellation periods stated above. The Photographer will issue a refund in the form of a cheque or bank transfer to the client no later than thirty (30) days upon receipt of the written cancellation notice.

    5. Travel. Any applicable travel fees are due in full prior to the start of the wedding. Mileage between locations to and from Harrow, Middlesex as defined by Google Maps: a) Travel costs are billed only if the total mileage travelled is greater than 100 miles round-trip from Harrow, Middlesex. b) Travel between 100m and 250m is billed at a flat rate of £150. c) Domestic travel greater than 300m is billed at a rate of £300, plus airfare and hotel accommodations if applicable. Determination of air versus car travel is solely at the Photographer's discretion. d) Fees for international travel are negotiated with the Client.

    6. Overtime. The overtime rate for additional time for the Photographer at the wedding is £250 per hour, prorated in increments of quarter hours. No overtime charges shall be incurred without the prior verbal or written authorisation of the Client. Any overtime requested shall be billed and payment due when the proofs are delivered.

    7. Photographer’s Copyright, Reproductions and Model Release. All photographic materials, including but not limited to digital files, negatives, transparencies, proofs, and previews, shall be the exclusive property of the Photographer and may not be reproduced or shared in any manner without the Photographer's express written permission. Client shall have a limited license to make and use copies of the images for their own personal use, on electronic mail and web pages. The Client shall not make copies for sale or for the purpose of circumventing sale of the images by the Photographer, nor will the Client authorise any reproductions of the images for commercial use. The negatives, digital files and previews remain the exclusive property of the Photographer unless otherwise stated or negotiated. If the digital negative files (high resolution TIFF images) are purchased or included as part of any Wedding Package, it is understood that the Photographer shall retain copyright for all images created and shall have the irrevocable and unrestricted right to use and publish photographs of the Client or in which the Client or their family or friends may be included, for editorial, trade, self-promotion, printed marketing material, Internet web sites, entry in photographic contests or art exhibitions, and any other purpose and in any manner and medium; and to alter the same without restriction. By signing this agreement, the Client consents to this model release.

    8. Photographer. The Photographer may substitute another photographer to take the photographs in the event of Photographer’s illness, injury or incase of any emergency. In the event of such substitution, the Photographer warrants that the photographer taking the photographs shall be a competent professional.

    9. Wedding Day Provisions & Limitations. The photography schedule is designed to accomplish the goals of the Client and the Photographer in a manner enjoyed by all parties. Because of factors out of our control including but not limited to; bad weather, poor backgrounds, wedding party delays, specific venue rules and restrictions, other people's flash or interference, Photographer shall not be responsible for missed photographs that are normally part of the contracted coverage. Because a wedding is an uncontrolled event, the Photographer cannot guarantee delivery of any specifically requested image(s). A hot meal is required for the Photographer(s) and assistant (if present) for coverage that continues through the reception. This meal should coincide with the guests' main course so that no photo opportunities are missed while the Photographer(s) and assistant eat.

    10. Creative License. F5 Photography Ltd shall be granted creative and artistic license in relation to the choice of locations, poses and compositions used. F5 Photography Ltd shall use personal artistic judgment to create images consistent with the photographer's personal vision of the event. F5 Photography Ltd’s judgement on photographic style and the number of photographs taken/provided to the client shall be deemed correct.

    11. Cooperation. F5 Photography Ltd will endeavour to honour any specific requests for photographs but will not undertake to guarantee any specific photograph nor incorporate any specific background, location or group arrangement. Any requests for specific photos of people and/or details must be provided in writing before the wedding day. F5 Photography Ltd is not responsible if key individuals fail to appear, co-operate or participate on the wedding day or during the ceremony, or for missed images due to details not revealed to F5 Photography Ltd or for any other reason outside of the photographer's control, including inclement weather conditions.

    12. Failure to Perform. If the Photographer cannot perform this Agreement due to a fire or other casualty, strike, act of God, or other cause beyond the control of the parties, or due to Photographer’s illness, then the Photographer shall return the retainer, and any balance paid, to the Client, but shall have no further liability with respect to the Agreement. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera malfunction, lost in the mail, fire or otherwise lost or damaged without fault on the part of the Photographer. In the event the Photographer fails to perform for any other reason, the Photographer shall not be liable for any amount in excess of the retail value of the Client’s order.

    13. Inherent Qualities. The Client is aware that over a long period of time, photographic materials may fade or discolour due to the inherent nature of dyes and emulsions. This process may be accelerated or even slowed depending on storage conditions, exposure to sunlight, extreme heat and temperature or moisture. The Client releases the Photographer from any liability for any claims whatsoever based upon fading or discolouration due to such inherent qualities.

    14. Limit of Liability. F5 Photography Ltd takes the utmost care with respect to exposure, transportation and processing of photographs; including using professional grade equipment and professional grade backup equipment. However, in the unlikely event of the client’s photographs being lost, stolen or destroyed for reasons within or beyond F5 Photography’s control, the latter’s liability is limited to the return of all payments received for the event package above. Your statutory rights are not affected. F5 Photography Ltd has full public liability and professional indemnity insurance. The total limit of liability shall not exceed the total package price stated herein. The performance of this contract on behalf of F5 Photography Ltd shall be contingent upon acts of God, flood, fire, warfare, government laws or regulations, electrical failure, strikes by suppliers, and/or conditions beyond its control.

    15. This Agreement incorporates the entire understanding of the parties. All verbal contracts, oral agreements or other written communication are void. This is a binding Agreement and any modifications of this Agreement must be in writing and signed by both parties. Any waiver of a breach or default hereunder shall not be deemed a waiver of a subsequent breach or default of either the same provision or any other provision of this Agreement. This Agreement shall be governed by the laws of the United Kingdom. This contract has been freely negotiated and shall be recognised as the entirety of the agreement. Only those changes or modifications specifically placed in writing, attached, dated and signed by the client and F5 Photography Ltd at the time of acceptance of this contract shall be recognised as amendments to this contract.

    16. Language Requirement. The parties have requested that this agreement be prepared in English.

  • The parties have read this Agreement in full, agree to all its terms, and acknowledge receipt of a complete copy of the Agreement electronically signed. The person electronically signing as Client below shall be fully responsible for ensuring that full payment is made pursuant to the terms of this Agreement.
